Display Case Design Unfair Competition and Copyright Infringement Appeal Rejected
Synthèse Legislator
Généré par l'IAThe Supreme Court rejected an appeal challenging a ruling that denied a claim of unfair competition and copyright infringement regarding display cases, finding that the appellate court acted within its sovereign discretion when assessing the originality of the display cases and determining that they differed significantly from the competing model in terms of moldings and polishing, thus concluding they were not slavish copies, rendering arguments about the non-examination of all elements' originality and imprecise prior art references ineffective against the factual findings of the lower court.

Sur les deux moyens réunis :
Attendu que le premier moyen, qui reproche à la cour d'appel d'avoir écarté la contrefaçon d'une vitrine, d'une part, en se bornant à retenir l'absence d'originalité d'un certain nombre d'éléments la composant, sans examiner l'originalité des autres, pris en eux-mêmes ou en combinaison, et, d'autre part, en faisant état d'antériorités sans en préciser la date, se heurte au pouvoir souverain reconnu aux juges du fond pour se prononcer sur le caractère d'originalité entraînant la protection légale, indépendamment de la notion d'antériorité, inopérante dans le cadre de l'application du droit de la propriété littéraire et artistique invoqué en la cause ;
Et attendu que le second moyen n'est pas mieux fondé, la cour d'appel ayant souverainement énoncé que les vitrines litigieuses différaient très nettement du modèle concurrent par leurs moulures et leur polissage, ces seules considérations suffisant à fonder l'appréciation des juges du fond selon laquelle ces vitrines ne constituaient pas des copies serviles, et justifiant le rejet de la demande fondée sur la concurrence déloyale ;
PAR CES MOTIFS :
REJETTE le pourvoi.
