Purchaser's Claim for Rescission of Van Sale Barred by Statute of Limitations for Hidden Defects
Synthèse Legislator
Généré par l'IAA purchaser sued for rescission of a van sale due to hidden defects, but the appellate court dismissed the claim, ruling that the action was not brought within the short time limit prescribed by the Civil Code. The appellant argued that the alleged defect, which rendered the vehicle unsuitable for its normal use, should have been treated as a breach of the seller's obligation to deliver a conforming good, thus excluding the application of the time limit. However, the Supreme Court upheld the appellate decision, reasoning that a lack of conformity of the item sold to its normal destination constitutes a defect covered by the provisions on hidden defects, making the one-year time limit applicable.

Généré par l'IAThe Court of Appeal correctly applied this article, which sets the time limit for action, because the defect was qualified as a hidden vice.
The court confirmed that the lack of conformity of the thing sold to its normal use constitutes the vice provided for by these articles, which justifies the application of Article 1648.

Sur le moyen unique :
Attendu que M. Y... a acheté le 2 novembre 1987 un véhicule fourgon Peugeot à M. X... ; que, par acte du 18 septembre 1989, il a fait assigner ce dernier en résolution de la vente pour vices cachés ;
Attendu que M. Y... fait grief à l'arrêt attaqué (Grenoble, 27 juin 1991) de l'avoir débouté de son action au motif que celle-ci n'avait pas été exercée dans le bref délai édicté par l'article 1648 du Code civil, sans rechercher si le vice allégué ne devait pas s'analyser, eu égard aux circonstances de la cause, en un manquement du vendeur à son obligation de délivrer un véhicule conforme à sa destination normale, ce qui aurait, selon le moyen, exclu l'application de l'article 1648 du Code civil ;
Mais attendu que le défaut de conformité de la chose vendue à sa destination normale constitue le vice prévu par les articles 1641 et suivants du Code civil et qu'ayant reconnu l'existence de cette impropriété du véhicule acheté par M. Y..., la cour d'appel a retenu à bon droit que l'article 1648 du même Code devait recevoir application en l'espèce ;
PAR CES MOTIFS :
REJETTE le pourvoi.
