Landlord-Tenant Eviction Notice Challenge and Preclusion Deadline
Synthèse Legislator
Généré par l'IAA commercial tenant sued its landlord to contest a notice to vacate and seek eviction compensation, commencing action on August 8, 1986, after the landlord served notice on April 18, 1983, setting the termination date for October 20, 1983, without offering indemnity. The appellate court found the action admissible because, due to non-observance of local custom for serving notice, the effective termination date was postponed to the next customary date, September 29, 1984, making the August 1986 filing timely under the two-year preclusion deadline expiring September 29, 1986. However, the high court quashed this decision, reasoning that the tenant failed to initiate proceedings within two years of the original stated termination date of October 20, 1983, thereby violating the mandatory two-year preclusion period stipulated by the relevant decree.

Sur le premier moyen :
Vu l'article 5, alinéa 5, du décret du 30 septembre 1953 ;
Attendu que le locataire qui entend, soit contester le congé, soit demander le paiement d'une indemnité d'éviction, doit, à peine de forclusion, saisir le Tribunal avant l'expiration d'un délai de 2 ans à compter de la date pour laquelle le congé a été donné ;
Attendu, selon l'arrêt attaqué (Aix-en-Provence, 17 décembre 1991), que la société civile immobilière La Bourdonnaise, propriétaire d'un immeuble à usage commercial, situé à Cannes, a, le 18 avril 1983, délivré congé à sa locataire, la société Laboratoire de recherches et de parfums Cannes pour la date d'expiration du bail, le 20 octobre 1983, sans offre d'indemnité d'éviction ; que, le 8 août 1986, la société locataire a assigné la bailleresse en contestation du congé et paiement d'une indemnité d'éviction ;
Attendu que, pour déclarer recevable cette action, l'arrêt retient que le congé, qui n'avait pas été donné suivant l'usage local, avant Pâques pour la Saint-Michel, le 29 septembre 1983, ne pouvait prendre effet qu'au terme d'usage de l'année suivante, le 29 septembre 1984, et que la société locataire avait valablement introduit sa demande le 8 août 1986, avant l'expiration du délai de forclusion, le 29 septembre 1986 ;
Qu'en statuant ainsi, alors que la société locataire n'avait pas saisi le Tribunal dans les 2 ans à compter de la date du 20 octobre 1983 pour laquelle le congé avait été donné, la cour d'appel a violé le texte susvisé ;
