Sur l'irrecevabilité du pourvoi soulevée d'office après avertissement donné aux parties :
Vu l'article 605 du nouveau Code de procédure civile ;
Attendu que M. X... demande la cassation d'un jugement (tribunal de commerce d'Angers, 7 février 1990) qui a déclaré irrecevable le recours par lui formé le 29 mai 1989 contre une ordonnance du juge-commissaire en date du 17 mai 1989 ayant autorisé la cession de l'actif mobilier de la société Le Ver d'eau, mise en liquidation judiciaire, au motif que ce recours avait été formé plus de 10 jours après le prononcé de l'ordonnance ; qu'il fait valoir que, l'ordonnance lui ayant été notifiée le 22 mai 1989, il disposait, en vertu de l'article 25 du décret du 27 décembre 1985, d'un délai de 8 jours à compter de cette notification pour former son recours et que le Tribunal a ainsi méconnu les principes fondamentaux de la procédure ;
Mais attendu qu'un tel recours en annulation du jugement pouvait être formé par la voie de l'appel ;
Et attendu que la voie de la cassation n'est ouverte que quand toutes les autres sont fermées ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi.
