SAFER Resale Authorization Obligation for Agricultural Holdings Consolidation
Synthèse Legislator
Généré par l'IAThe case concerned a challenge to the refusal to annul the resale of land parcels by a rural land development society (SAFER) to various farmers, where the lower court ruled that the obligation for the recipient farmer to obtain prior authorization regarding the consolidation of agricultural holdings exceeding the legal threshold, as required by the Rural Code, was solely the responsibility of the acquirer, as the transfer document followed common law sales rules. The high court quashed this decision, reasoning that the SAFER should have made the resale conditional upon the beneficiary farmer obtaining the requisite prior authorization, thereby violating the relevant article of the law concerning the regulation of agricultural holding consolidation.

Sur le moyen unique :
Vu l'article 16 de la loi du 5 août 1960 ;
Attendu que les opérations immobilières réalisées par les sociétés d'aménagement foncier d'établissement rural (SAFER) s'effectuent sous réserve, notamment, des dispositions du titre VII du livre 1er du Code rural, relatives aux cumuls et réunions d'exploitations agricoles ;
Attendu que, pour débouter Mme X... de sa demande en annulation de rétrocession de parcelles de terre, à divers exploitants, acquises par la SAFER Marché-Limousin, l'arrêt attaqué (Limoges, 20 juin 1991) retient que l'acte par lequel est réalisé le transfert de propriété entre la SAFER et l'attributaire obéit au droit commun de la vente, et qu'en conséquence, l'obligation d'autorisation préalable aux cumuls de surfaces d'exploitation, excédant le seuil légalement fixé, prévue par l'article 188-2 du Code rural, est exclusivement à la charge de l'attributaire ;
Qu'en statuant ainsi, alors que la SAFER Marché-Limousin aurait dû subordonner la rétrocession à l'obtention, par l'exploitant bénéficiaire, d'une autorisation préalable, la cour d'appel a violé le texte susvisé ;
