Preliminary Judgment Appealability in Provisional Rent Determination
Synthèse Legislator
Généré par l'IAThe appellate court erred by declaring the tenant's appeal admissible against a preliminary judgment that ordered an expert valuation of the premises to determine the provisional rent, based on the incorrect finding that this preliminary judgment decided a part of the principal by setting a ceiling removal for the renewed lease and fixing the start date for provisional rent. The court of cassation ruled that judgments only partially deciding the merits and ordering an instruction measure are generally not independently appealable unless specifically provided by law, and since the initial judgment only ordered an expertise and fixed a provisional rent without settling the core dispute, the appeal was inadmissible, leading to the quashing of the appellate decision without referral back to the lower court.

Généré par l'IAThe Court of Appeal violated this article by incorrectly deeming an appeal admissible against a preliminary judgment that only ordered expert assessment and provisional rent.
This article was applied to justify the cassation without referral because the error did not require re-adjudication on the merits.

Sur le moyen unique :
Vu l'article 545 du nouveau Code de procédure civile ;
Attendu que les jugements, qui ne tranchent pas dans leur dispositif une partie du principal et ordonnent une mesure d'instruction, ne peuvent être frappés d'appel indépendamment du jugement sur le fond que dans les cas spécifiés par la loi ;
Attendu que pour déclarer recevable l'appel formé par M. X..., locataire, d'un jugement rendu le 6 mai 1988, l'arrêt attaqué (Aix-en-Provence, 26 février 1991) retient que cette décision tranche en son dispositif une partie du principal dans la mesure où il décide que le prix du bail renouvelé doit être déplafonné en raison du caractère monovalent des locaux et fixe au 1er avril 1986 le point de départ du loyer provisionnel ;
Qu'en statuant ainsi, alors que le jugement se bornait, en son dispositif, à ordonner une expertise sur la valeur locative des locaux, dont le caractère monovalent n'était pas alors contesté, et à fixer un loyer provisionnel, la cour d'appel a violé le texte susvisé ;
Et attendu qu'il y a lieu de faire application de l'article 627, alinéa 1er, du nouveau Code de procédure civile, la cassation encourue n'impliquant pas qu'il soit à nouveau statué au fond ;
PAR CES MOTIFS :
CASSE ET ANNULE, dans toutes ses dispositions, l'arrêt rendu le 26 février 1991, entre les parties, par la cour d'appel d'Aix-en-Provence ;
DIT n'y avoir lieu à renvoi.
