Paternity Acknowledgment Annulment Time-Barred Without Prior Judicial Ruling
Synthèse Legislator
Généré par l'IAAn individual sought the annulment of a paternity acknowledgment he made in 1941, alleging fraud (dolus), an action which the lower court declared time-barred, despite the claimant arguing that a subsequent acknowledgment by another man in 1961 interrupted the thirty-year prescription period. The high court upheld the lower court's decision, reasoning that under the applicable 1955 law, a contradictory filiation could not be recognized without a prior judicial ruling establishing the inaccuracy of the first acknowledgment; since no such ruling existed, the 1961 act was legally void and could not interrupt the prescription period for the fraud action.

Sur le moyen unique :
Attendu que M. Louis, Roland X..., né le 6 janvier 1941, a été reconnu le 8 janvier suivant par M. Louis X... ; qu'il a fait l'objet, le 26 septembre 1961, d'une nouvelle reconnaissance, souscrite par M. Y... ; que, le 18 mai 1988, M. Louis X... a assigné M. Louis, Roland X... et M. Y... en annulation, pour dol, de la reconnaissance dont il était l'auteur ; que l'arrêt attaqué (Fort-de-France, siégeant à Cayenne, 4 février 1991) a déclaré son action prescrite ;
Attendu que M. Louis X... reproche à cet arrêt d'avoir ainsi statué alors que la reconnaissance souscrite en 1961 par M. Y... impliquait une contestation de la précédente reconnaissance et avait pour effet d'interrompre la prescription trentenaire, de sorte que l'action intentée en 1988 était recevable ; qu'en décidant le contraire, la cour d'appel aurait violé les articles 311-7 et 2244 du Code civil ;
Mais attendu que, selon l'article 342- bis du Code civil, issu de la loi du 15 juillet 1955, alors applicable, nulle filiation contraire à une filiation établie par un acte, ou un jugement, ne pouvait être postérieurement reconnue sans qu'un jugement établisse, préalablement, l'inexactitude de la première ; qu'en l'espèce, la cour d'appel a constaté qu'aucune décision judiciaire n'établissait l'inexactitude de la reconnaissance souscrite par M. Louis X... ; qu'elle en a exactement déduit que, la reconnaissance souscrite par M. Henri Y... étant dès lors dépourvue de tout effet juridique, cet acte n'était pas susceptible d'interrompre la prescription ; d'où il suit qu'en statuant comme ils l'ont fait, les juges du second degré ont légalement justifié leur décision ;
