Defamation Suit: Revocation of Pleading Closure and Procedural Fairness
Synthèse Legislator
Généré par l'IAAn individual sued the director of a weekly publication and the publishing company for damages due to alleged defamation in an article, leading the trial court to revoke the initial order closing the pleadings and postpone it to the hearing date. The defendants appealed, arguing the court erred by ruling on the merits without reopening the debate after revoking the closure order, violating procedural articles; however, the appellate court upheld the decision, reasoning that the revocation was necessary to respect the principle of adversarial proceedings because the defendants had not been able to reply to the plaintiff's submissions served on the day the closure order was made, and further, the appealing party could not challenge a procedural measure they themselves had requested to allow for a reply.

Sur le premier moyen :
Attendu, selon l'arrêt confirmatif attaqué (Paris, 11 juin 1991), que, s'estimant diffamé par un article intitulé " ... " paru dans l'hebdomadaire Y..., M. Z... a demandé au directeur de la publication du journal, M. X..., et à la société d'édition du journal la réparation de son préjudice ;
Attendu qu'il est fait grief à l'arrêt, qui a révoqué l'ordonnance de clôture et reporté la clôture à la date de l'audience des plaidoiries, d'avoir statué au fond sans rouvrir les débats et d'avoir ainsi violé les articles 16, 783 et 784 du nouveau Code de procédure civile, une même décision ne pouvant révoquer l'ordonnance de clôture et statuer au fond ;
Mais attendu que l'arrêt retient que M. X... et la société d'édition n'ayant pas été en mesure de répliquer aux écritures de M. Z... signifiées le jour de l'ordonnance de clôture, il y avait lieu, pour respecter le principe du contradictoire, de révoquer cette ordonnance et de la reporter au jour de l'audience ;
Et attendu que l'ordonnance de clôture ayant été révoquée à la demande de M. X... qui entendait seulement répliquer aux conclusions de M. Z..., M. X... n'est pas fondé à critiquer la mesure qu'il avait sollicitée ;
Sur le second moyen : (sans intérêt) ;
PAR CES MOTIFS :
REJETTE le pourvoi.
