Jurisdiction Over Family Home Attribution During Divorce Appeal
Synthèse Legislator
Généré par l'IAThe Court of Cassation quashed a decision that affirmed the jurisdiction of the family affairs judge to rule on the attribution of the family home after a divorce decree had been appealed to the highest court. The appellate court had reasoned that the family judge's competence, permitted by the Civil Procedure Code for provisional measures like custody or alimony even during a cassation appeal, should extend to all urgent, precarious provisional measures, including the attribution of the family home previously awarded to the other spouse in the non-conciliation order. The high court ruled that the scope of the specified article does not extend to the attribution of the family home, declaring the family judge incompetent, and thereby cassating the lower court's ruling without referral.

Sur le premier moyen :
Vu l'article 1084 du nouveau Code de procédure civile ;
Attendu que, si le juge aux affaires matrimoniales peut, après le prononcé du divorce, et même si un pourvoi en cassation a été formé, statuer sur l'exercice de l'autorité parentale ou la modification de la pension alimentaire, sa compétence ne s'étend pas à l'attribution de la jouissance du logement familial ;
Attendu, selon l'arrêt attaqué, que l'arrêt qui a prononcé le divorce des époux X..., a fait l'objet d'un pourvoi en cassation ; qu'alors que la procédure était pendante devant la Cour de Cassation, Mme Y... a demandé à un juge aux affaires matrimoniales l'attribution de la jouissance du logement familial, donnée à M. X... par l'ordonnance de non-conciliation ; que M. X... a soulevé l'incompétence de ce juge ;
Attendu que, pour retenir la compétence du juge aux affaires matrimoniales, l'arrêt énonce que les dispositions de l'article 1084 du nouveau Code de procédure civile doivent être étendues à toutes les mesures qui présentent un caractère essentiellement provisoire, dont l'objet est de faire face à une situation précaire ;
Qu'en se déterminant ainsi, la cour d'appel a violé le texte susvisé ;
Vu l'article 627 du nouveau Code de procédure civile ;
PAR CES MOTIFS, et sans qu'il y ait lieu de statuer sur les autres moyens :
CASSE ET ANNULE, dans toutes ses dispositions, l'arrêt rendu le 15 avril 1991, entre les parties, par la cour d'appel de Montpellier ;
DIT n'y avoir lieu à renvoi ;
DECLARE le juge aux affaires matrimoniales incompétent.
