Contractor v. Owner and Work Manager Regarding Expert Evidence and Guarantor Liability
Synthèse Legislator
Généré par l'IAAn owner sued a contractor for breach of a construction contract after the work manager excluded the contractor from the site, and the owner ratified the exclusion, leading the contractor to sue the owner, who then called the work manager as a guarantor. The appellate court held that an expert report, obtained via summary proceedings in the contractor-owner dispute where the work manager was present as a non-party, was opposable to the work manager and held them liable as guarantor because they participated and were heard during the expertise. The high court quashed this part of the decision, reasoning that the ruling against the work manager, which relied on the expert findings, violated the principle of adversary proceedings because the work manager had not been summoned as a party in the expert designation procedure and did not participate as a party in the expert operations.

Texte complet
Sur le premier moyen :
Vu l'article 16 du nouveau Code de procédure civile ;
Attendu que le juge doit, en toutes circonstances, faire observer et observer lui-même le principe de la contradiction ;
Attendu, selon l'arrêt attaqué (Riom, 14 mars 1991), que M. X..., maître de l'ouvrage, a, en 1988, fait procéder aux travaux de réhabilitation d'un immeuble lui appartenant, avec le concours de M. Z..., maître d'oeuvre, et de M. Y..., entrepreneur, chargé, par contrat du 17 octobre 1988, de travaux de plâtrerie, peinture et isolation ; que M. Z... ayant, le 4 avril 1989, notifié à M. Y... son exclusion du chantier et cette décision ayant été confirmée par le maître de l'ouvrage à l'entrepreneur, le 7 avril 1989, ce dernier a, le 20 octobre 1989, fait assigner, en réparation du préjudice résultant de la rupture du marché, le maître de l'ouvrage, qui a appelé en garantie le maître d'oeuvre ;
Attendu que, pour déclarer opposable à M. Z... l'expertise ordonnée en référé dans l'instance ayant opposé M. Y... à M. X... et condamner M. Z... à garantir M. X... des condamnations prononcées contre lui, au profit de M. Y..., pour rupture du marché, l'arrêt relève que M. Z..., convoqué en qualité de maître d'oeuvre aux opérations d'expertise, y a assisté et a été entendu " parlant parfois en tant que conseil de M. X... " et que le rapport d'expertise, régulièrement versé aux débats, a été soumis à la discussion contradictoire des parties ;
Qu'en statuant ainsi, alors que M. Z..., dont la condamnation est fondée sur les conclusions de l'expert, n'avait pas été assigné dans la procédure en désignation de l'expert et n'avait pas été présent aux opérations d'expertise en qualité de partie, la cour d'appel a violé le texte susvisé ;
