Astreinte Enforcement in Commercial Property Eviction: Applicability of 1949 Limitation Law
Synthèse Legislator
Généré par l'IAThe case concerns a party who remained in possession of commercial property after it was forcibly sold to another entity, leading to a court order for eviction under penalty (astreinte). After the occupation indemnity was fixed and the astreintes liquidated in separate judgments, an appellate court incorrectly rejected the liquidation of the astreintes, which was subsequently overturned by a higher court. On appeal regarding the liquidation of the astreintes, the appellant argued that the law of July 21, 1949, limiting astreintes in eviction cases to proven prejudice, should apply to all occupants, including a former owner held as a judicial sequestrator. The court rejected this argument, holding that the 1949 law was inapplicable because the party was obligated to vacate the premises in its capacity as the seller responsible for delivery, thus justifying the enforcement of the full astreinte order.

Attendu, selon l'arrêt attaqué (Lyon, 10 juin 1991), rendu sur renvoi après cassation d'un précédent arrêt, et les productions, que la Société d'exploitation d'industries touristiques (la société), s'étant maintenue dans un immeuble dont elle était propriétaire et acquis sur vente forcée par M. X..., le juge des référés a ordonné son expulsion sous astreinte ; que, par jugements distincts, l'indemnité d'occupation a été fixée et les astreintes liquidées ; que, sur appel de la société, un arrêt a rejeté la demande de liquidation d'astreinte ; que cet arrêt a été cassé par la deuxième chambre civile de la Cour de Cassation, le 6 décembre 1989, en ce qu'il avait rejeté la demande de liquidation d'astreinte et avait ordonné, par voie de conséquence, la mainlevée d'une hypothèque provisoire précédemment autorisée ;
Sur le moyen unique, pris en sa première branche : (sans intérêt) ;
Sur la seconde branche du moyen :
Attendu qu'il est reproché à l'arrêt d'avoir dit que la société devait être tenue, outre l'indemnité d'occupation, au paiement des astreintes prononcées par le premier juge, alors que l'article 2 de la loi du 21 juillet 1949 limitant les astreintes en matière d'expulsion au préjudice effectivement causé s'appliquerait, en vertu de l'article 1er du même texte, à tout " occupant " d'un local, ce qui inclurait nécessairement le propriétaire d'un local commercial constitué séquestre judiciaire dudit local à la suite de sa vente sur saisie immobilière, et qu'en décidant le contraire la cour d'appel aurait violé l'article 1er de la loi du 21 juillet 1949 ;
Mais attendu que la société devant libérer les lieux en sa qualité de venderesse tenue à délivrance, la loi du 21 juillet 1949 était inapplicable ;
Que, par ce motif de pur droit, substitué à ceux que le moyen critique, la décision déférée se trouve légalement justifiée ;
PAR CES MOTIFS :
REJETTE le pourvoi.
