Lessee Indemnity Claim for Lease Termination and Change of Agricultural Use
Synthèse Legislator
Généré par l'IAThe lessee sued the lessor for compensation under Article L. 411-32 of the Rural Code after the amicable termination of the lease agreement, which was followed immediately by the lessor obtaining authorization to convert the agricultural plot into a pond, arguing this constituted a change in the destination of the leased premises. The appellate court upheld the indemnity because the amicable termination did not constitute a recognized settlement, but the supreme court quashed this decision, reasoning that the indemnity for a premature termination due to a change in agricultural use is only due from the lessor who initiated the termination to modify the property's destination, a condition not met when the tenant willingly renounced the lease.

Sur le moyen unique :
Vu l'article L. 411-32 du Code rural ;
Attendu, selon l'arrêt attaqué (Douai, 28 février 1991), que Mme X... a acquis, le 27 janvier 1988, une parcelle de terre dont le locataire, M. Y..., a renoncé au droit au bail, moyennant le versement d'une somme de 5 000 francs effectué le même jour ; que la propriétaire ayant obtenu, dès le 3 février 1988, l'autorisation de creuser un étang sur cette parcelle, M. Y..., estimant qu'elle avait changé la destination des lieux, l'a assignée afin d'obtenir une indemnisation du préjudice subi, comme en cas d'expropriation, en application de l'article L. 411-32 du Code rural ;
Attendu que pour condamner Mme X... à payer à M. Y... une somme de 16 801,80 francs en plus de 5 000 francs déjà versés, l'arrêt retient que la circonstance que la résiliation soit intervenue amiablement par consentement mutuel et non dans le cadre d'un procès est sans influence sur l'étendue du droit à indemnité expressément reconnu au profit du locataire par l'article L. 411-32 du Code rural, sauf constatation d'un accord à caractère de transaction non établi en l'espèce ;
Qu'en statuant ainsi, alors que l'indemnisation du preneur, en cas de changement de la destination agricole de la parcelle louée, n'est due que par le bailleur qui a pris l'initiative de résilier prématurément le bail pour modifier la destination des lieux, la cour d'appel a violé le texte susvisé ;
