Water Infiltration Damages and Subcontractor Guarantee Appeal Admissibility
Synthèse Legislator
Généré par l'IAThe appeal before the Court of Cassation was deemed inadmissible because the challenged judgment from the trial court, which involved a primary action for damages due to water infiltration and a subsequent cross-claim for guarantee by the general contractor against its subcontractor and the subcontractor's insurer, was determined to have been rendered in the first instance regarding the guarantee claim. The court reasoned that although the main claims did not meet the threshold for appeal, the guarantee claim sought a global indemnity exceeding the final appeal threshold established for the trial court, and since the principal action and the guarantee action, while connected, were distinct, the appeal against the portion of the judgment related to the guarantee claim was not available as it was not rendered in the last resort.

Sur la recevabilité du pourvoi, contestée par la défense :
Vu l'article 605 du nouveau Code de procédure civile ;
Attendu que le pourvoi en cassation n'est ouvert qu'à l'encontre des jugements rendus en dernier ressort ;
Attendu, selon le jugement attaqué (tribunal d'instance de Nancy, 25 mai 1990), qu'appelée en garantie par la société Le Triangle, maître de l'ouvrage, qui avait été condamnée à payer des indemnités au syndicat des copropriétaires de la résidence Le Triangle et à divers copropriétaires agissant à titre individuel, en réparation des dommages causés par des infiltrations d'eau dans l'installation de chauffage central de l'immeuble, la société Halle, qui avait participé à la construction en qualité d'entreprise générale, a elle-même formé un recours en garantie contre sa sous-traitante, la société Lambert et contre l'assureur de cette dernière, la Compagnie des souscripteurs des Lloyd's de Londres ;
Attendu que si aucune des prétentions émises dans la même instance par les demandeurs principaux n'excédait le taux du dernier ressort fixé pour le tribunal d'instance par l'article R. 321-1 du Code de l'organisation judiciaire, la demande en garantie formée par la société Halle tendait à la condamnation de la société Lambert et de son assureur au paiement d'une indemnité globale dont le montant était supérieur au taux du dernier ressort, et que, dès lors, l'action principale et celle en garantie étant connexes mais distinctes, même si elles sont réunies dans une même instance, le jugement a été rendu en premier ressort sur la demande formée par la société Halle ; que le pourvoi en cassation formé par la société Lambert et par son assureur contre ce chef du jugement est irrecevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi
