Synthèse Legislator

The appellate court erred in upholding the validity of a lease termination notice concerning farmland because it incorrectly determined that the land was eligible for construction, despite acknowledging that the zoning plan classified the parcel as a natural zone (NA) rather than an urban zone, thereby violating the relevant provisions of the Rural and Urban Planning Codes concerning lease termination and land use classification.

Sur le premier moyen :

Vu l'article L. 411-32 du Code rural, ensemble l'article R. 123-18 du Code de l'urbanisme ;

Attendu que pour déclarer valable le congé délivré le 27 avril 1988, par Mmes X..., Y... et de Antoni, propriétaires, à M. Z..., leur fermier, pour l'ensemble des terres données à bail, l'arrêt attaqué (Toulouse, 21 juin 1990) retient que, selon le plan d'occupation des sols (POS), la surface de plus d'un hectare rendant la parcelle 365 apte à des opérations de lotissement ou d'édification d'ensembles d'habitations, accordait à celle-ci une aptitude à la constructibilité l'englobant dans le cadre plus large des zones urbaines de ce plan qui ne comprennent pas seulement les zones de terrains déjà équipés ;

Qu'en statuant ainsi, tout en relevant, par motifs propres et adoptés, que la parcelle avait été classée par le POS en zone NA et qu'une telle zone relève des zones naturelles et non urbaines, la cour d'appel a violé les textes susvisés ;
