Property Owner v. Occupant and Company: Jurisdiction and Merits Ruling Appealability
Synthèse Legislator
Généré par l'IAThe appeal court correctly declared the appeal inadmissible against a lower court decision that, in an eviction action concerning a property owner against an occupant and a company, found no lease agreement existed and declined jurisdiction in favor of the higher court. The reasoning was that by determining the absence of a lease, the lower court had ruled on the substantive issue governing its jurisdiction, meaning the appropriate remedy against such a mixed decision concerning both competence and the merits was an appeal via a specific procedural challenge, not the appeal that was filed.

Sur le moyen unique :
Attendu qu'il est fait grief à l'arrêt attaqué (cour d'appel de Versailles, 12 juillet 1991) d'avoir déclaré irrecevable l'appel d'un jugement d'un tribunal d'instance qui, saisi d'une demande d'expulsion d'un local occupé par M. Y... et la société TTM, formée par Mme X..., propriétaire de ce local, a constaté l'absence de convention locative entre eux et s'est déclaré incompétent au bénéfice du tribunal de grande instance, alors qu'en jugeant, dans son dispositif, qu'il n'existait pas de convention locative, le juge d'instance aurait statué sur le fond du litige eu égard à l'ensemble des prétentions des parties et qu'ainsi la cour d'appel, en présence d'un tel jugement statuant à la fois sur la compétence et sur le fond du litige, n'aurait pu déclarer l'appel irrecevable sur la base de l'article 80 du nouveau Code de procédure civile, inapplicable en la cause, sans violer ses dispositions et celles de l'article 78 du nouveau Code de procédure civile ;
Mais attendu que c'est à bon droit que la cour d'appel a retenu qu'en constatant l'absence de contrat de louage entre les intéressés, le tribunal d'instance n'avait fait que trancher la question de fond dont dépendait la compétence et que la décision ne pouvait être attaquée que par voie du contredit ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi.
