Railway Welfare Fund Death Benefit Subrogation Denial
Synthèse Legislator
Généré par l'IAAn entity that paid a death benefit to the surviving spouse of a retired employee following a traffic accident sued the at-fault driver and their insurer to recover that payment. The appellant argued that because the benefit was paid by the entity managing the mandatory social security scheme for railway agents, the court of appeal erred in denying recovery by violating a specific 1985 law concerning subrogation rights. However, the high court upheld the lower court's decision, reasoning that the death benefit was stipulated by the internal "pensions" regulation of the entity's welfare fund, not by its mandatory social security scheme, thus characterizing the payment as statutory in nature, which precluded the entity from relying on the cited law to claim reimbursement.

Sur le moyen unique :
Attendu, selon l'arrêt infirmatif attaqué (Amiens, 20 juin 1991), que, Mme X... étant décédée des suites d'un accident de la circulation, la Société nationale des chemins de fer français (SNCF), dont le mari de la victime était retraité, a versé à celui-ci une allocation décès ; qu'en vue d'obtenir le remboursement de cette prestation, elle a assigné l'auteur responsable de l'accident, M. Y..., et son assureur, Les Mutuelles unies ;
Attendu qu'il est fait grief à l'arrêt d'avoir débouté la SNCF de sa demande, alors que la prestation étant versée par un établissement gérant un régime obligatoire de sécurité sociale pour les agents retraités ou ayants droit du chemin de fer, la cour d'appel aurait violé l'article 29-1 de la loi du 5 juillet 1985 ;
Mais attendu que l'arrêt retient que c'est le règlement intérieur " retraites " de la Caisse de prévoyance de la SNCF, et non cette dernière en tant qu'organisme de sécurité sociale, qui prévoit le versement d'une allocation décès au conjoint d'un agent décédé ;
Que, de ces énonciations, la cour d'appel a exactement déduit que cette prestation avait un caractère statutaire, ne relevant pas du régime obligatoire de sécurité sociale, et que la SNCF ne pouvait se prévaloir de l'article 29-1 de la loi du 5 juillet 1985 pour en obtenir le remboursement ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi.
