Homeowners v. Transport Company (Prescription Period)
Synthèse Legislator
Généré par l'IAHomeowners who sued a transport company for missing furniture packages, filed their main action on August 13, 1987, after an expert was appointed in summary proceedings on April 22, 1986, and the expert's reports were filed on July 31 and September 5, 1986, were deemed time-barred from seeking damages because the court found that proceeding with the main action more than one year after the expert appointment order constituted a late filing, thereby rejecting the appeal claiming violation of the Civil and Commercial Codes regarding the interruption of prescription.

Sur le moyen unique :
Attendu qu'il est fait grief à l'arrêt attaqué (Paris, 16 février 1990), d'avoir déclaré les époux X..., qui avaient confié à la société Global international l'enlèvement et le transport de leur mobilier, irrecevables en leur action en dommages-intérêts engagée le 13 août 1987 pour la disparition de plusieurs colis lors de la livraison effectuée le 18 février 1986, après qu'un expert eut été désigné en référé, alors que l'objet d'une procédure de référé aux fins d'expertise ne saurait être la seule désignation de l'expert mais l'expertise elle-même qui se termine par le dépôt au greffe du tribunal d'un rapport d'expert, et qu'en l'espèce, l'expert désigné par l'ordonnance de référé du 22 avril 1986 ayant déposé son rapport le 31 juillet 1986 et un rapport complémentaire le 5 septembre 1986, et l'assignation au fond ayant eu lieu le 13 août 1987, soit moins d'un an plus tard, ce serait en violation des articles 2244 du Code civil et 108 du Code de commerce que l'arrêt attaqué aurait déclaré irrecevable l'action en dommages-intérêts des époux X... ;
Mais attendu que l'arrêt énonce exactement qu'en procédant à l'assignation au fond plus d'un an après l'ordonnance de désignation d'expert, les époux X... ont agi tardivement ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi.
