Buyer Liable for Previous Owner's Maintenance Fees Due to Failure to Notify Association
Synthèse Legislator
Généré par l'IAThe buyer of a condominium unit, who acquired the property through a court-ordered auction (adjudication), was held liable by the trial court to pay the previous owner's outstanding maintenance charges to the co-ownership association because the buyer failed to notify the association of the judgment of adjudication as required by law. The highest court rejected the appeal, reasoning that the trial court correctly established the buyer's obligation to notify the association and, in light of the buyer's failure to do so, legally justified its decision by noting that the buyer did not prove the association would have been unable to collect the debt regardless of the lack of notification, particularly considering the financial terms of the sale.

Généré par l'IAThis article established the obligation for the appellant (acquirer) to notify the co-ownership association of the adjudication judgment, which the court found was not fulfilled.
Although cited in the reasoning against the burden of proof, it was not explicitly relied upon in the final rejection order, which confirms the lower court's finding regarding the appellant's failure to prove the inability of the syndicate to recover the debt.

Sur le moyen unique :
Attendu que M. Y..., adjudicataire d'un lot de copropriété appartenant à Mlle X..., fait grief au jugement attaqué (tribunal d'instance d'Annecy, 16 octobre 1989), statuant en dernier ressort, de le condamner à payer au syndicat des copropriétaires les charges arriérées dues par cette dernière, alors, selon le moyen, 1°) que la procédure de l'opposition -qui a pour but d'éviter une saisie-arrêt- suppose essentiellement une vente volontaire ; qu'ainsi, en assimilant purement et simplement l'adjudication à une telle cession, le Tribunal a violé, par fausse application, les articles 20 de la loi du 10 juillet 1965 et 5 du décret du 17 mars 1967 ; 2°) que l'adjudicataire n'est jamais de plein droit responsable des arriérés impayés par le précédent propriétaire ; que si le transfert de propriété doit être notifié au syndic, cette formalité, nécessairement postérieure à ce transfert, a pour objet de rendre l'acquéreur de lot propriétaire à l'égard du syndicat ; qu'ainsi, le Tribunal, qui s'est borné à énoncer des considérations d'ordre général, mais qui s'est abstenu de rechercher si l'état des inscriptions permettait au syndicat -dépourvu de tout privilège et toujours primé, même opposant, par les créanciers régulièrement inscrits- de recouvrer sa créance, et si le défaut de notification lui avait causé un préjudice réel, n'a pas légalement justifié sa décision au regard de l'article 6 du décret du 17 mars 1967 ; 3°) que le Tribunal, qui a fait peser sur le défendeur à l'instance la charge d'établir que la demande du syndicat était injustifiée, a violé les articles 1315, paragraphe 1er, du Code civil et 9 du nouveau Code de procédure civile ;
Mais attendu qu'après avoir exactement retenu qu'en application des dispositions de l'article 20 de la loi du 10 juillet 1965, M. Y... avait l'obligation de notifier au syndicat des copropriétaires le jugement d'adjudication, et constaté qu'il ne l'avait pas fait, le Tribunal, sans inverser la charge de la preuve, a légalement justifié sa décision en relevant que M. Y... n'établissait pas que le syndicat n'aurait, de toute façon, pas pu obtenir paiement de sa créance, " eu égard aux conditions financières de la vente " ;
