Tenant Improvement Compensation Dispute in Land Liquidation
Synthèse Legislator
Généré par l'IAAn individual, being the outgoing tenant of inherited farmland undergoing liquidation, sought compensation for improvements made under rural code provisions, but the lower court denied this claim, suggesting the civil code provision regarding jointly owned property applied instead. The high court rejected the appeal, reasoning that since the appellant had not presented any claim based on the rules of joint ownership to the appellate court, that court could not introduce and apply that basis for indemnity without altering the scope of the dispute.

Sur le moyen unique :
Attendu qu'il résulte tant des écritures des parties que des énonciations de l'arrêt attaqué, que M. Louis X... a sollicité, par application de l'article L. 411-69 du Code rural, le bénéfice de l'indemnité due au preneur sortant, pour des améliorations apportées par lui, au fonds rural dépendant de la succession, en liquidation, de son père ; que l'intéressé fait grief à l'arrêt attaqué (Lyon, 1er février 1990) de l'avoir débouté de cette prétention en retenant que les dispositions du Code rural n'étaient pas applicables en l'espèce, mais en ne tenant pas compte de ce que les améliorations litigieuses concernaient un bien indivis et devaient être indemnisées selon l'article 815-13 du Code civil ;
Mais attendu que la cour d'appel n'ayant été saisie d'aucune demande fondée sur les règles de l'indivision, elle ne pouvait, sans modifier l'objet du litige, faire application du texte prétendument violé ; que le moyen ne peut être accueilli ;
