Attendu que M. X... fait grief au jugement attaqué de l'avoir condamné, ainsi que d'autres tiers électeurs, au paiement d'une somme en application de l'article 700 du nouveau Code de procédure civile, après avoir constaté qu'ils s'étaient désistés de leur recours tendant à la radiation d'électeurs sur la liste électorale de Petreto-Bicchisano alors que le désistement ne permettait pas une telle condamnation ;

Mais attendu que le désistement d'instance comporte, sauf convention contraire, soumission de payer les frais de l'instance éteinte ;

Et attendu que le Tribunal a pu, après avoir constaté le désistement des demandeurs, prononcer à leur encontre une condamnation sur le fondement de l'article 700 du nouveau Code de procédure civile ;

D'où il suit que le moyen n'est pas fondé ;
