Improper Merits Ruling Following Undisposed Jurisdiction Exception
Synthèse Legislator
Généré par l'IAA lower court improperly ruled on the merits of a claim after dismissing a defendant's exception of lack of jurisdiction without first formally ordering the parties to submit their arguments on the substance of the case, which is required by procedural rules when a court intends to rule both on the exception and the merits in the same decision. Because the record did not show the defendant had provided substantive defenses or had been formally directed to do so before the judgment on the merits—which found against the defendant based on a lack of contestation—the decision was insufficiently based in law, leading to the partial cassation of the judgment regarding the monetary condemnation and referral for retrial on that specific issue.

Sur le moyen unique :
Vu l'article 76 du nouveau Code de procédure civile ;
Attendu que le juge qui entend rejeter une exception d'incompétence et statuer au fond dans le même jugement, doit, préalablement, mettre les parties en demeure de conclure sur le fond si elles ne l'ont déjà fait ;
Attendu que le jugement attaqué, rendu en dernier ressort, après avoir écarté une exception d'incompétence soulevée par le défendeur, a, statuant au fond, condamné M. X... à payer au Cabinet AAL une certaine somme en retenant qu'il n'avait pas contesté les termes de la demande ;
Qu'en statuant ainsi, alors qu'il ne résulte pas de ces énonciations que M. X... ait fourni des explications sur le fond ou ait été mis en demeure de le faire, le tribunal d'instance n'a pas donné de base légale à sa décision ;
