Appeal Against Fee Taxation Order Pending Supreme Court Decision
Synthèse Legislator
Généré par l'IAThe appellant challenged a lower court order setting the remuneration due to legal representatives who acted for his adversaries, arguing that the order should have been stayed pending the outcome of a supreme court appeal against the judgment that allocated costs against him, as an annulment of the judgment would consequently void the fee taxation order. The court rejected this argument, holding that no statute obliges the presiding judge to suspend the taxation of the fees and emoluments of legal representatives pending a decision by the supreme court on a stayed judgment.

Sur le premier moyen :
Attendu qu'il est fait grief à l'ordonnance attaquée, rendue par le premier président d'une cour d'appel, en matière de taxe (Orléans, 19 juin 1990), d'avoir fixé la rémunération due par M. Z... à MM. X... et Y..., avoués ayant occupé pour plusieurs de ses adversaires dans l'instance qui l'opposait à ces derniers, alors que, si l'arrêt ayant mis les dépens à sa charge, frappé d'un pourvoi en cassation, venait à être annulé, cette annulation, en vertu des articles 625, alinéa 2, et 639 du nouveau Code de procédure civile, entraînerait par voie de conséquence celle de l'ordonnance de taxe ;
Mais attendu qu'aucun texte n'oblige le premier président à surseoir à la taxation des frais et émoluments des avoués ayant occupé pour les parties dans une instance ayant donné lieu à un arrêt frappé d'un pourvoi en cassation jusqu'à la décision de la Cour de Cassation ;
D'où il suit que le moyen n'est pas fondé ;
Sur le second moyen, pris en ses deux branches : (sans intérêt) ;
PAR CES MOTIFS :
