Parental Support Obligation vs. Adult Child Cohabitation Requirement
Synthèse Legislator
Généré par l'IAThe court quashed part of a lower court's decision which allowed a parent to pay child support for an adult child directly to that child, instead of to the other parent, based on the finding that the receiving parent did not prove cohabitation with the adult child. The high court reasoned that since it was not disputed that the receiving parent bore the principal responsibility for supporting the adult child who could not provide for themselves, the appellate court violated the relevant civil code article by applying a condition—cohabitation—not required by the statute for directing payments to the parent assuming the principal charge.

Vu l'article 295 du Code civil ;
Attendu que le parent qui assume à titre principal la charge d'enfants majeurs qui ne peuvent eux-mêmes subvenir à leurs besoins, peut demander à son conjoint de lui verser une contribution à leur entretien et à leur éducation ;
Attendu que pour dire que M. Y... pourra verser la contribution à l'entretien d'un enfant majeur directement à celui-ci, et rejeter la demande de versement entre les mains de Mme X..., la cour d'appel retient que celle-ci ne justifie pas vivre avec l'enfant ;
Qu'en statuant ainsi, alors qu'il n'était pas contesté que Mme X... assurait à titre principal la charge de l'enfant, la cour d'appel a pris en considération une condition non prévue par l'article susvisé et l'a violé ;
