Insurance Fund Reimbursement for Oxygen Supply in Hyperbaric Therapy
Synthèse Legislator
Généré par l'IAThe primary sickness insurance fund reimbursed a patient for hyperbaric oxygen therapy sessions, but the lower court ordered the fund to additionally reimburse the cost of the oxygen supply, reasoning that its omission from the listed act's billing code meant it was not included in the act's cost. The reviewing court quashed this decision, holding that the general nomenclature of professional acts was irrelevant to the dispute, and that the interministerial tariff for certain health services explicitly covered the contested product for domiciliary oxygen therapy, requiring the lower court to have determined if the conditions of that latter text were met instead of relying on an irrelevant coding standard.

Sur le moyen unique :
Vu le chapitre III du titre XV de la nomenclature générale des actes professionnels annexée à l'arrêté ministériel du 27 mars 1972 et l'arrêté du 30 décembre 1949 instituant un tarif interministériel pour le règlement de certaines prestations sanitaires ;
Attendu que la caisse primaire d'assurance maladie a remboursé à M. X... les séances d'oxygénothérapie hyperbare dont il a bénéficié du 4 au 10 mars et du 6 au 10 avril 1987 ; que, pour condamner l'organisme social à rembourser en sus la fourniture d'oxygène, le jugement attaqué énonce essentiellement que l'absence de référence dans la cotation à la fourniture d'oxygène implique que cette fourniture n'est pas comprise dans le coût de l'acte ;
Qu'en statuant ainsi, alors que la nomenclature générale des actes professionnels est étrangère au litige et que le tarif interministériel pour le règlement de certaines prestations sanitaires prévoit la prise en charge du produit litigieux dans le cas d'oxygénothérapie à domicile, le Tribunal, qui n'a pas recherché si les conditions de cette prise en charge étaient remplies au regard de ce dernier texte, a privé sa décision de base légale ;
