Husband's Appeal on Jurisdiction Over Ancillary Property Claims in Divorce
Synthèse Legislator
Généré par l'IAThe husband appealed a decision that granted the divorce on the grounds of his fault, specifically challenging the ruling that only the judges responsible for the matrimonial property settlement were competent to rule on his ancillary claims for the restitution of personal property, the return of an apartment security deposit, and authorization to lease an indivisible property. The high court rejected the appeal, reasoning that the appellate court correctly determined that these specific claims related directly to the liquidation of the matrimonial property regime and therefore fell within the exclusive jurisdiction of the specialized liquidation judge, thereby not violating the relevant civil code provisions.

Sur le troisième moyen :
Attendu qu'il est fait grief à l'arrêt attaqué, qui a prononcé le divorce des époux X... aux torts du mari, d'avoir dit que les juges chargés de la liquidation sont seuls compétents pour connaître des demandes de M. X... tendant à la restitution d'objets mobiliers, du dépôt de garantie de l'appartement et à obtenir l'autorisation de donner à bail un bien indivis ;
Mais attendu que c'est sans violer les dispositions de l'article 264-1 du Code civil que la cour d'appel a retenu que les demandes de M. X..., relatives à la restitution d'objets mobiliers et d'un dépôt de garantie de l'appartement, et à l'obtention de l'autorisation de donner à bail un bien indivis, avaient trait à la liquidation du régime matrimonial et devaient être soumises aux juges chargés de cette liquidation ;
D'où il suit que le moyen n'est pas fondé ;
