Servitude Extinction Based on Aggravation of Servient Estate
Synthèse Legislator
Généré par l'IAWhere neighboring property owners had established a conventional right-of-way servitude across one property to access a stable, the lower court erred in extinguishing the servitude based on the owner of the dominant estate altering the stable into a kitchen, thereby aggravating the condition of the servient estate by allowing vehicles to access both the building and the garden, because the aggravation of the servient estate's condition is not a ground for the extinction of a servitude under the Civil Code articles governing servitudes.

Sur le moyen unique :
Vu les articles 703 à 706 du Code civil ;
Attendu, selon l'arrêt attaqué (Rennes, 3 février 1988), que les époux Y... et les consorts X... sont propriétaires de fonds contigus ; que, selon acte du 14 mars 1947, une servitude conventionnelle de passage a été constituée sur le fonds des époux Y... au profit du fonds X..., pour accéder à une écurie ;
Attendu que, pour déclarer éteinte cette servitude conventionnelle, l'arrêt retient que le changement d'état des lieux provenant du fait du propriétaire du fonds dominant a aggravé la condition du fonds servant puisque les véhicules qui utilisent le passage accèdent indistinctement au bâtiment et au jardin, contrairement à l'objet particulier de la servitude, et que ce changement, consistant dans la transformation de l'écurie en arrière-cuisine, a éteint la servitude ;
Qu'en statuant ainsi, alors que l'aggravation de la condition du fonds servant n'est pas une cause d'extinction de la servitude, la cour d'appel a violé les textes susvisés ;
