Appellant v. Notorious Insolvency Standard in Alsace-Moselle Bankruptcy
Synthèse Legislator
Généré par l'IAThe appellant sought the opening of bankruptcy proceedings against her, arguing that for a non-commercial individual in the Alsace-Moselle departments, "notorious insolvency" under the relevant 1985 law merely required a durably compromised financial situation, not an irremediable one. The Court of Cassation rejected the appeal, affirming that the appellate court correctly applied the cited text by finding that the appellant was not in a state of notorious insolvency, thereby correctly refusing to open judicial reorganization proceedings.

Sur le moyen unique :
Attendu que Mme X... fait grief à l'arrêt attaqué (Colmar, 11 mai 1988) d'avoir rejeté sa demande tendant à l'ouverture à son égard d'une procédure de redressement judiciaire, alors, selon le pourvoi, que, conformément à l'article 234 de la loi du 25 janvier 1985, l'insolvabilité notoire, condition nécessaire de l'ouverture d'un redressement judiciaire contre une personne physique, ni commerçante, ni artisan, ni agricultrice, domiciliée dans les départements d'Alsace ou de Moselle, s'entend d'une situation financière durablement compromise ; que dès lors, en l'espèce, en exigeant la preuve d'une situation irrémédiablement compromise et de l'absence de possibilité d'obtenir des crédits, la cour d'appel a violé le texte susvisé ;
Mais attendu que c'est par l'exacte application du texte invoqué que la cour d'appel, ayant constaté que Mme X... ne se trouvait pas en état d'insolvabilité notoire, a décidé qu'il n'y avait pas lieu de la mettre en redressement judiciaire ; qu'ainsi le moyen est sans fondement ;
