Généré par l'IAThe court declared the appeal inadmissible because the judgment being challenged, which resolved an incident following the conversion of a judicial mortgage foreclosure into a voluntary sale under specific procedural rules, was not made in the last resort and was therefore subject to appeal, meaning the cassation appeal was premature as the lower court's decision was appealable according to the articles governing such conversions.

Généré par l'IAThe provision is cited indirectly in the reasoning regarding the inapplicability of appeal restrictions, which supports the procedural conclusion about the judgment being subject to appeal (and thus the inadmissibility of the subsequent cassation appeal).
The provision defining appeal restrictions is discussed to confirm that the judgment in question was susceptible to appeal, which implies the final decision's basis.
The provision governing the conversion of forced sale into voluntary sale is discussed as context for the procedural posture of the case.

Sur la recevabilité du pourvoi :
Attendu que si la conversion d'une saisie immobilière en vente volontaire dans les conditions prévues à l'article 744 du Code de procédure civile n'enlève pas à la vente son caractère de vente forcée par autorité de justice, le jugement des incidents postérieurs à la conversion n'est pas soumis aux restrictions du droit d'appel instituées par l'article 731 de ce Code, auquel ne renvoie pas son article 748 e ;
Attendu que le jugement attaqué (tribunal de grande instance de Grenoble, 20 décembre 1988) a statué, postérieurement à la conversion de la poursuite de saisie immobilière en vente volontaire, sur un incident opposant la société Promoloisir, partie saisie, qui avait été mise en redressement judiciaire avant l'audience d'adjudication et demandait, en conséquence, l'annulation de la vente sur saisie immobilière, à la société Midland Bank, créancier poursuivant ; qu'un tel jugement n'a pas été rendu en dernier ressort et était susceptible d'appel ;
PAR CES MOTIFS :
