A patent holder for a device intended for loading a skip onto a vehicle sued two companies for infringement. The patent holder argued that the appellate court erred in rejecting a finding of equivalent infringement, asserting that when a patent covers a novel combination of known elements, infringement occurs if the alleged infringing device achieves the same function, even with a different structure. However, the higher court upheld the appellate court's decision, reasoning that the court below had correctly determined, based on its factual assessment, that the patented invention merely combined elements to achieve a known function, and that the patent only protected that specific combination's form; since the accused device, while performing the same function, utilized a different structure than that claimed in the patent, the court correctly refused to find infringement by equivalence for a function not explicitly protected.

Sur le moyen unique :

Attendu que, selon l'arrêt attaqué (Paris, 1er décembre 1988), la Société nouvelle de bennes Saphem (société Saphem), titulaire du brevet n° 70-35-574 ayant pour objet un " dispositif pour le chargement d'une benne sur un véhicule ", a demandé la condamnation pour contrefaçon de la société Guima et de la société Paris Sud hydraulique ;

Attendu que la société Saphem fait grief à l'arrêt d'avoir dit, selon le pourvoi, que le brevet portant sur une combinaison de moyens connus n'était pas contrefait par un dispositif employant un moyen de structure exerçant la même fonction alors que s'agissant d'une combinaison nouvelle de moyens connus, la contrefaçon par équivalence est réalisée par un dispositif qui met en oeuvre des moyens assurant la même fonction, même s'ils sont de structure différente ; que la cour d'appel a violé les articles 6 et 29 de la loi du 2 janvier 1968 ;

Mais attendu que, par une appréciation souveraine, la cour d'appel a retenu que la combinaison des moyens mis en oeuvre par l'invention exerçait une fonction connue et que le brevet protégeait seulement cette combinaison dans sa forme ; qu'elle a constaté que le dispositif argué de contrefaçon, tout en ayant la même fonction, avait une structure différente de celle qui était revendiquée par le brevet ; qu'elle a ainsi, à juste titre, refusé de retenir une contrefaçon par équivalence d'une fonction non protégée ; d'où il suit que le moyen n'est pas fondé ;
