Appeal Inadmissibility Due to Untimely Filing After Initial Notification
Synthèse Legislator
Généré par l'IAThe Court of Cassation declared the appeal inadmissible because it was filed on February 20, 1989, against a decision initially notified on May 9, 1988, and subsequently served on January 10, 1989; the reasoning was that a service of process occurring after the deadline for appeal, which had already commenced upon the first notification, could not restart the statutory period for filing the appeal, thereby rendering the later-filed appeal untimely under the relevant civil procedure article.
