Manager's Challenge to Staff Committee Election Ruling Deemed Inadmissible
Synthèse Legislator
Généré par l'IAA company employee, who was a manager, challenged a prior ruling by the lower court that denied the creation of a separate electoral college for managers in staff committee elections, arguing that since he was not a party to the initial proceeding, his subsequent challenge should be admissible, but the Court of Cassation upheld the decision declaring his claim inadmissible, reasoning that the initial judgment concerning professional elections could only be challenged via an appeal to the Court of Cassation, not through an opposition proceeding, thus legally justifying the dismissal of the employee's claim despite the lower court's potentially superfluous reasoning.

Attendu que par jugement du 17 mars 1989, le tribunal d'instance du 8e arrondissement de Paris a décidé qu'il n'y avait pas lieu d'instituer un collège spécial " cadres " pour les élections des membres du personnel au comité d'entreprise de la société Carita ;
Attendu que M. X..., cadre de cette société, se prévalant du fait qu'il n'avait pas été partie à l'instance ayant abouti à ce jugement, a, le 22 juin 1989, contesté la suppression du 3e collège ;
Attendu que M. X... reproche au jugement attaqué (tribunal d'instance de Paris, 8e arrondissement, 24 novembre 1989) d'avoir déclaré sa demande irrecevable au motif qu'il n'avait pas formé de tierce opposition, alors que le juge a violé les dispositions du Code du travail qui, par interprétation en particulier de son article L. 433-11, ne permettent pas l'exercice d'une tierce opposition à un jugement rendu par le tribunal d'instance en matière d'élections professionnelles ;
Mais attendu que le jugement du 17 mars 1989 ne pouvait être attaqué par l'intéressé que par la voie du recours en cassation ; d'où il suit qu'abstraction faite du motif surabondant, exactement critiqué par le pourvoi, le juge, qui a déclaré la demande de M. X... irrecevable, a légalement justifié sa décision ;
