Sur le moyen unique :
Attendu qu'il est fait grief à l'ordonnance attaquée d'avoir enjoint à la société à responsabilité limitée Entreprise EFIC de payer une certaine somme au Bureau d'études Robert Bourdel, au motif que la demande paraissait fondée, alors que toute ordonnance d'injonction de payer revêtue de la formule exécutoire constituant un jugement, en ne la motivant pas, le tribunal de commerce aurait violé l'article 455 du nouveau Code de procédure civile ;
Mais attendu que l'article 1409 du nouveau Code de procédure civile, aux termes duquel si, au vu des documents présentés, la demande lui paraît fondée en tout ou partie le juge, rend une ordonnance portant injonction de payer pour la somme qu'il retient, n'impose pas à ce magistrat l'obligation de motiver sa décision ;
D'où il suit que le moyen n'est pas fondé ;
