Creditor's Appeal Against Reorganization Plan Confirmation Inadmissible by Supreme Court
Synthèse Legislator
Généré par l'IAThe case involved a creditor appealing a judgment that confirmed a judicial reorganization plan for several companies, which included a partial sale of assets alongside business continuation; the court of appeal subsequently declared the creditor's appeal against the reorganization judgment inadmissible, based on the initial inadmissibility ruling by the supervisory judge, and the creditor then lodged a cassation appeal against this decision. The Supreme Court declared the cassation appeal inadmissible, reasoning that under the relevant provisions of the 1985 law, a creditor is barred from exercising an appeal to the Court of Cassation against a decision that confirms a reorganization plan involving the continuation of the business coupled with a partial transfer of its operations.

Sur la recevabilité du pourvoi :
Attendu, selon l'arrêt attaqué (Aix-en-Provence, 26 avril 1988), que dans le cadre de la procédure de redressement judiciaire commune ouverte à l'égard des sociétés SICA ABC, Unimidi SA SICA et Le Charcutier de Provence (les sociétés), le Tribunal a arrêté un plan de redressement organisant la continuation de l'entreprise assortie d'une cession partielle de ses éléments d'exploitation ; que l'appel interjeté par la caisse de mutualité sociale agricole des Bouches-du-Rhône (la caisse), créancière des sociétés, a été déclaré irrecevable par le conseiller de la mise en état, en application de l'article 174 de la loi du 25 janvier 1985 ; qu'après avoir débouté la caisse de son recours contre l'ordonnance ainsi rendue, la cour d'appel a déclaré irrecevable l'appel de la caisse tendant à l'annulation du jugement entrepris et que sa décision, sur ce point, a fait l'objet d'un recours en cassation de la part de la caisse ;
Attendu qu'il résulte tant des dispositions de l'article 171.2° de la loi du 25 janvier 1985, que de la combinaison des articles 174, alinéa 2, et 175 de la même loi, qu'un créancier ne peut exercer un recours en cassation contre une décision qui a arrêté le plan de redressement de l'entreprise en organisant sa continuation assortie d'une cession partielle ; que le pourvoi formé par la caisse est donc irrecevable ;
