Landlord v. Tenant's Spouse: Termination of Joint Rent Liability Pre-Divorce
Synthèse Legislator
Généré par l'IAThe tenant contested a ruling that her spouse was not jointly liable for rent payments, arguing that co-tenancy necessarily implies joint and several liability until a final divorce decree assigning occupancy terminates this obligation. The court rejected this, upholding the appellate decision on the basis that the spouse validly terminated the contractual relationship with the landlord by issuing a notice of departure, which was sufficient grounds to release him from the joint and several obligation for rent concerning the dwelling occupied by the other spouse prior to a final divorce judgment.

Sur le premier moyen :
Attendu que Mme X..., locataire d'un appartement dont la Caisse des dépôts et consignations est propriétaire, fait grief à l'arrêt attaqué (Versailles, 22 janvier 1988) d'avoir décidé que M. X... n'était pas tenu solidairement au paiement des loyers alors, selon le moyen, " que la cotitularité du bail entre les époux implique nécessairement leur solidarité quant au paiement des loyers ; qu'il s'ensuit que seul le jugement de divorce devenu définitif, comportant attribution du logement à l'un d'eux, peut mettre fin à cette solidarité, ceux-ci restant tenus solidairement jusqu'à la dissolution du mariage ; qu'ainsi, en décidant que la résiliation unilatérale du mari auprès du bailleur le libérait de son obligation solidaire de paiement du loyer du logement occupé par sa femme avant que le jugement de divorce soit définitif et transcrit, la cour d'appel a violé les articles 220 et 1751 du Code civil " ;
Mais attendu qu'ayant retenu que M. X... avait valablement mis fin, par la délivrance d'un congé, au lien contractuel l'unissant à la Caisse des dépôts et consignations, la cour d'appel a, par ce seul motif, légalement justifié sa décision de ce chef ;
