Property Owner v. Glazing Installer: Classification of Double Glazing Under Ten-Year Warranty
Synthèse Legislator
Généré par l'IAA property owner sued the installer of insulating double glazing for damages, with the work accepted in 1974 and the claim filed in 1983. The appellate court deemed the action admissible by classifying the glazing, due to its thermal/acoustic insulation and its embedded frames contributing to the main structure's stability, as "gros ouvrages" (major works) subject to the ten-year warranty. However, the high court quashed this decision, reasoning that the appellate court failed to legally base its ruling by not investigating whether the frames were fixed or mobile, a distinction necessary to properly apply the relevant construction liability articles.

Sur le moyen unique :
Vu les articles 1792 et 2270 du Code civil, dans leur rédaction résultant de la loi du 3 janvier 1967, applicable en la cause, ensemble les articles R. 111-26 et R. 111-27 du Code de la construction et de l'habitation ;
Attendu, selon l'arrêt attaqué (Rennes, 17 mars 1988), que M. X... a fait poser par la société Miroiteries de Bretagne des doubles vitrages isolants dans la maison d'habitation qu'il faisait édifier ; que la réception des travaux est intervenue le 23 avril 1974 ; que, se plaignant de désordres, le maître de l'ouvrage en a, le 21 juin 1983, réclamé réparation à cette société ;
Attendu que, pour déclarer l'action recevable, l'arrêt retient, par motifs propres et adoptés, que les vitrages litigieux, qui assurent une isolation thermique et phonique et sont insérés dans des châssis ou cadres porteurs encastrés dans la construction et contribuant à la bonne tenue du gros oeuvre, constituent des gros ouvrages relevant de la garantie décennale ;
Qu'en statuant ainsi, sans rechercher si ces châssis ou cadres étaient fixes ou mobiles, la cour d'appel n'a pas donné de base légale à sa décision ;
