Joint and Several Guarantors Barred from Benefit of Division
Synthèse Legislator
Généré par l'IAWhere multiple parties act as joint and several guarantors for the same debt, they cannot invoke the benefit of division against the creditor pursuing them jointly and severally, unless otherwise agreed. The Court of Appeal erred in allowing two joint and several guarantors, who had guaranteed the same debt under the same private agreement, to claim the benefit of division, reducing each to liability for half the total amount based on the mistaken reasoning that the act only provided for solidarity between each guarantor and the principal debtor, not among the guarantors themselves, thereby violating the relevant Civil Code articles concerning joint and several obligations and suretyship.

Texte complet
Sur le moyen unique pris en sa troisième branche :
Vu les articles 2021, 2025, 2026, ensemble l'article 1203 du Code civil ;
Attendu qu'il résulte de la combinaison de ces textes que lorsque plusieurs personnes se sont rendues cautions solidaires d'un même débiteur pour une même dette, elles ne peuvent, sauf convention contraire, opposer au créancier qui les poursuit solidairement en paiement le bénéfice de division ;
Attendu que par un même acte sous seing privé MM. Y... et X... se sont portés cautions solidaires de la société anonyme Y... frères envers le Crédit industriel d'Alsace et de Lorraine, à concurrence de la somme de 120 000 francs ; que, sur les poursuites de cet établissement bancaire contre les deux cautions, la Cour d'appel a admis qu'elles pouvaient se prévaloir du bénéfice de division et n'étaient donc tenues, au titre du cautionnement précité, qu'au paiement d'une somme de 60 000 francs chacune, et cela au motif "que l'acte ne prévoyait aucune solidarité des cautions entre elles, mais seulement une solidarité entre chacune des cautions et le débiteur principal";
Attendu qu'en statuant ainsi, la Cour d'appel a violé les textes susvisés ;
