The case concerned a request by a husband, of Spanish nationality and domiciled in France, to convert a pre-existing, irrevocable judicial separation of body and property, granted in 1971 upon the wife's request, into a divorce in 1976. The Court of Appeal dismissed the request, ruling that the conversion was governed by the conflict of laws rule in force prior to the 1975 law, based on transitional provisions which stipulated that the new law did not apply if the initial request predated its entry into force, interpreting the "initial request" as the original petition for separation. The highest court overturned this decision, reasoning that the transitional article (Article 24 of the 1975 Law) only established internal transition rules and did not govern the conflict of laws rule, which remained determined by general principles demanding the immediate application of the new unilateral conflict rule expressed in the subsequent Civil Code article (Article 310), thereby finding the lower court had violated both cited provisions by misapplying the former and refusing to apply the latter.
