An employer, having been denied a maximum remission of late payment surcharges for social security contributions by a first-instance commission and subsequently ordered on counterclaim to pay the non-remissible portion exceeding the final jurisdiction limit of the Tribunal d'Instance, appealed the denial of remission, arguing it was a dispute over the debt amount not subject to the strict final jurisdiction rule, while the collection agency cross-appealed the admissibility of the entire appeal, arguing the commission's decision on remission was final. The court rejected both appeals, reasoning that the commission rules strictly limit appeal on decisions concerning remission requests (Article 20), but rule subject to appeal when ruling on payment demands exceeding the lower court's final jurisdiction limit (Article 21), thereby justifying the appellate court's decision to declare the appeal on the remission denial inadmissible while finding the appeal on the payment order admissible for further review.
