ATTENDU QU'IL RESULTE DE CE TEXTE QUE LE PREFET TRANSMET A LA JURIDICTION DE L'EXPROPRIATION UN DOSSIER COMPRENANT OBLIGATOIREMENT LES COPIES CERTIFIEES CONFORMES DES PIECES SOUMISES AU CONTROLE DU JUGE;

ATTENDU QUE L'ORDONNANCE ATTAQUEE QUI PRONONCE AU PROFIT DE LA COMMUNE DE MONTBRISON L'EXPROPRIATION POUR CAUSE D'UTILITE PUBLIQUE D'UNE PARCELLE DE TERRE APPARTENANT A M X... VISE L'AVIS DE LA COMMISSION DEPARTEMENTALE DES OPERATIONS IMMOBILIERES ET EN MENTIONNE L'ANNEXION;

QUE LE DOCUMENT AINSI ANNEXE NE COMPORTE AUCUNE SIGNATURE ET N'EST PAS UNE COPIE CERTIFIEE CONFORME;

QU'IL S'ENSUIT QUE L'ORDONNANCE EST ENTACHEE D'UN VICE DE FORME QUI DOIT EN FAIRE PRONONCER L'ANNULATION;

PAR CES MOTIFS, ET SANS QU'IL Y AIT LIEU DE STATUER SUR LES AUTRES MOYENS : CASSE ET ANNULE L'ORDONNANCE RENDUE ENTRE LES PARTIES LE 7 NOVEMBRE 1980 PAR LE JUGE DE L'EXPROPRIATION DU DEPARTEMENT DE LA LOIRE, SIEGEANT A SAINT-ETIENNE;

REMET, EN CONSEQUENCE, LA CAUSE ET LES PARTIES AU MEME ET SEMBLABLE ETAT OU ELLES ETAIENT AVANT LADITE ORDONNANCE ET, POUR ETRE FAIT DROIT, LES RENVOIE DEVANT LE JUGE DE L'EXPROPRIATION DU DEPARTEMENT DE LA HAUTE-LOIRE, SIEGEANT AU PUY.
