An employee contested a decision by the board of directors to deduct a financial activities tax from savings bond commissions *before* their distribution to personnel, arguing the historical practice of distributing the full commission constituted an acquired right to remuneration. The court rejected the appeal, holding that a ministerial circular establishing minimum and maximum percentages for commission distribution held regulatory force, meaning the previous irregular distribution practice by the savings bank could not create an acquired right in violation of the regulation; thus, the board acted legally in applying the tax deduction prospectively to undistributed amounts based on the established regulatory framework.

Art. 1134 du Code civil

This article is cited in the grounds of appeal, but since the Court of Cassation rejected the appeal, it implies that the lower court's application or interpretation concerning the binding nature of the previous commission distribution practice was upheld, as the lower court was deemed to have acted regularly.

Art. 455 du Code de procédure civile

Cited in the grounds of appeal concerning the alleged lack of motivation, which was implicitly rejected by the Court's finding that the lower court legally justified its decision.
