The seller, having agreed to transport tiles and sanitary ware to the buyer and charge the buyer with the risks of transport, was nonetheless held liable for the cost of damaged goods because the appellate court found that despite the risk transfer, the seller retained the obligation to ensure the goods were adequately packed for shipment. The Court of Cassation upheld this decision, reasoning that the exclusive cause of the damage was the insufficient packing, which constituted a fault on the part of the seller, thus precluding its claim for payment of the damaged items; furthermore, the claim that the buyer accepted the risk of inadequate packaging was an inadmissible new argument on appeal.
