The dispute arose after an employer attempted to dismiss an employee who held staff representative status, which was initially blocked by the labor inspectorate, then validated only after a lengthy judicial process where administrative decisions were overturned. The employee sought reinstatement, arguing the subsequent dismissal for redundancy was a fraudulent maneuver to circumvent prior rulings protecting him, but the lower court only awarded damages for unfair dismissal, refusing reinstatement because the protective mandate had expired and the employee did not specifically claim the nullity of the dismissal based on the mandate. The highest court rejected the claim for reinstatement because the employee did not properly invoke the right based on his expired representative status, but it partially quashed the decision regarding the calculation of severance pay because the appellate court failed to rule on the employee's specific claims regarding his classification (staff/manager level) and the corresponding indemnity amounts, erroneously concluding the parties agreed on the lower figure offered by the employer.
