A wine producer sued a railway company for trademark infringement, alleging that the latter's use of the designation "Domaine de Romanet" for an Algerian wine sold in its canteens constituted counterfeiting of its registered marks "Domaine de la Romanée-Conti" and "Romanée Conti." The appellate court ruled in favor of the producer, finding that the term "Romanée" was determinative and protectable due to its arbitrary character, and that its reproduction constituted infringement, citing the defendant's intent to cause confusion. However, the high court quashed this decision because the appellate court failed to assess whether a risk of confusion actually existed in the minds of the clientele between the complex registered trademarks and the defendant's labels, independent of the defendant's subjective motivations, thus lacking a legal basis for its ruling.
