Synthèse Legislator

A party appealed a ruling by the President of a Commercial Court who granted a payment order requested by a merchant against a non-merchant, arguing the court lacked jurisdiction because the dispute did not concern a commercial act involving a non-merchant. The High Court dismissed the appeal, holding that under the relevant decree, the only available remedy against an order for payment is an objection ("contredit"), rendering the appeal inadmissible.

SUR LE MOYEN UNIQUE :

ATTENDU QUE DEMEL FAIT GRIEF AU PRESIDENT D'UN TRIBUNAL DE COMMERCE DE S'ETRE RECONNU COMPETENT POUR VISER UNE ORDONNANCE D'INJONCTION DE PAYER REQUISE DE LUI PAR CALASSOU, COMMERCANT, A L'ENCONTRE D'UN NON-COMMERCANT, ALORS QUE, SELON LE MOYEN, LE DEFENDEUR N'ETANT PAS COMMERCANT, LE PRESIDENT DU TRIBUNAL DE COMMERCE ETAIT INCOMPETENT POUR CONNAITRE D'UN LITIGE NE PORTANT PAS SUR UN ACTE DE COMMERCE ;
