A liquidator of an insolvent company appealed a decision that allowed an appeal filed by a debtor of the company, arguing the debtor's appeal was void because it was not placed on the court roll within the time limit prescribed by Article 905 of the New Code of Civil Procedure. The Court of Cassation rejected the appeal, affirming the lower court's ruling that an appeal initiated by the liquidator via summons, pursuant to Article 108, paragraph 1 of the Decree of December 22, 1967, concerning judicial settlements and bankruptcy, is not governed by the procedural requirements of Article 905 of the New Code of Civil Procedure, thereby validating the admissibility of the debtor's appeal.
