Généré par l'IA

A worker injured in a work accident in 1972 appealed a ruling that denied compensation for non-pecuniary damages and lost professional promotion opportunities under the 1976 law, arguing the new law should apply retroactively to the consequences of prior accidents. The Court rejected the appeal, reasoning that while the new law's provisions on fault and premium increases could potentially apply retroactively, the compensation for moral prejudice established a new right that could not be applied to facts predating its enactment without violating the principle of non-retroactivity set forth in the Civil Code, distinguishing this new right from the scope of a specific social security article addressing those previously ineligible for accident benefits.
