Synthèse Legislator

An employee, a sales representative, entered into a settlement agreement just before the termination of his employment contract, where he received a lump-sum payment in full settlement of all potential termination indemnities, including client indemnity. He appealed, arguing the agreement was void because it constituted an invalid advance fixation of client indemnity contrary to labor law, and that he signed under moral duress without meaningful negotiation. The court upheld the lower court's decision, reasoning that the settlement agreement, reached after discussions concerning various claims, was valid under civil code provisions governing settlements, as it occurred upon the termination of the contract, not during its execution, thus circumventing the specific labor law prohibition against anticipatory clauses within an ongoing contract, and that the trial court had sufficiently established the agreement involved mutual concessions and found no evidence of the alleged moral constraint.
