A party challenged the jurisdiction of the Tribunal de Grande Instance to hear a personal liability action brought against a court-appointed administrator concerning alleged faults committed during judicial settlement proceedings, arguing that jurisdiction belonged exclusively to the Tribunal de Commerce which opened the settlement, pursuant to rules centralizing litigation related to such proceedings. The Court of Cassation rejected this appeal, affirming that the appellate court was justified in asserting jurisdiction because the liability action, if successful, would only result in the payment of personal damages by the administrator and would not alter the solutions or outcomes of the primary judicial settlement procedure itself.
