Liquidator Appeal Regarding Payment of Strike Salaries
Synthèse Legislator
Généré par l'IAThe liquidator of a company appealed a decision ordering the payment of salaries for the period of a strike (June 11-28, 1977) to several employees, arguing that the liquidation judgment suspended all claims and that the employees failed to file their claims properly, which the court rejected on the grounds that the liquidator had not raised the issue of irregular filing before the labor tribunal, making it a new and inadmissible argument. Regarding the second ground that the employees' claim amounted to unjust enrichment because it lacked consideration, the court upheld the ruling, finding that an agreement existed for the company to pay for the strike hours if work resumed on a specific date following the strike, which was initiated due to the company's failure to pay prior wages, thus establishing a valid cause for the employer's commitment to compensate the employees for the prejudice caused.
