In a case concerning the resolution of a property sale and damages, an appellate court declared an action inadmissible because a defendant raised an objection regarding the plaintiff's failure to comply with property publicity formalities only after filing its substantive pleadings in the first instance, relying on the procedural rule that certain objections are only receivable if raised before the conclusion on the merits. The high court quashed the decision, reasoning that the failure to publish the claim for resolution of sale does not constitute one of the specific exceptions exhaustively listed in the relevant articles of the Code of Civil Procedure that can be raised late, thus constituting a misapplication of that procedural article.
